These Terms and Conditions ("Terms") govern your access to and use of rayah-uae.com (the "Site") and any purchase made through it, operated by Rayah Al Fakhama Trading LLC, trading as Rayah ("Rayah," "we," "us," or "our"). By accessing, browsing, or purchasing from the Site, you agree to be bound by these Terms, together with our Privacy Policy and our Refund & Shipping Policy, which are incorporated here by reference. If you do not agree to these Terms, please do not use the Site.

1. Use of the Site

We grant you a limited, non-exclusive, non-transferable licence to access and use the Site for personal, non-commercial purposes. You may not:

(i) Use the Site for any unlawful purpose;

(ii) Copy, modify, distribute, or create derivative works from any part of the Site;

(iii) Interfere with or disrupt the Site or its servers; or

(iv) Use any automated system, including robots, spiders, scrapers, or data-mining tools, to access or collect data from the Site.

You must be at least 18 years of age and legally capable of entering into binding contracts to place an order.

2. Products, Condition & Transparency

Rayah is an independent boutique specialising in luxury fashion and accessories. Our pieces are brand new and unused, presented in their original packaging, but are classified as pre-owned because they are sourced by our team from trusted resellers and suppliers worldwide rather than acquired through the brands' authorised retail channels.

We are an independent reseller and are not affiliated, associated, authorised, endorsed by, or in any way officially connected with any of the brands offered on the Site, nor with their subsidiaries or affiliates. All trademarks, brand names, logos, and product images remain the property of their respective owners and are used on the Site for descriptive and illustrative purposes only.

3. Authenticity Guarantee

Every item is store-sourced or acquired from trusted, verified sellers and is inspected on receipt before it is offered for sale. All pieces are supplied with their full packaging and an invoice.

We stand behind the authenticity of everything we sell. In the unlikely event that an item is ever proven to be inauthentic, you are entitled to a full refund for the lifetime of the piece, in accordance with our Refund & Shipping Policy.

4. Pricing & Product Information

We make every effort to describe and photograph our pieces accurately. Please note that colours and finishes may appear differently across screens and devices, and slight variations are not considered defects.

All prices are listed in the currency shown at checkout and are inclusive of applicable taxes unless stated otherwise. Prices, descriptions, and availability may change at any time without notice. We reserve the right to correct any errors and to refuse or cancel an order arising from an obvious pricing or description error, even after an order has been confirmed; in such cases any amount paid will be refunded.

5. Orders, Deposits & Acceptance

Your order constitutes an offer to purchase. All orders are subject to acceptance and to the availability and successful sourcing of the item. We reserve the right to decline or cancel any order at our discretion, in which case any amount paid will be refunded.

To reserve a piece, we may accept a deposit of 10–20% of the item's value, which holds the item for three (3) working days. As set out in our Refund & Shipping Policy, deposits are non-refundable on cancellation but may be transferred toward another piece.

6. Identity Verification

Because of the high value of our pieces and to protect against fraud, we may require you to provide a copy of your Emirates ID or passport before an order is dispatched. The name and address on your identification must match the payment and delivery details provided. Where this information does not correspond, or is not supplied in a timely manner, we reserve the right to delay or decline the order and process a refund. Any information you provide is handled in accordance with our Privacy Policy.

7. Shipping, Delivery & Returns

Delivery timeframes, insurance, customs responsibilities, and our return, refund, and exchange process are set out in full in our Refund & Shipping Policy, which forms part of these Terms. In summary, all sales are considered final by default, with exceptions only for confirmed authenticity issues, damage, or defects reported within the timeframes stated in that policy.

8. Intellectual Property

All content on the Site, including text, graphics, layout, and design elements, is the property of Rayah or its licensors and is protected by applicable intellectual property laws. You may not reproduce or use any content from the Site without our prior written permission or, where relevant, the permission of the applicable brand owner.

9. User Content

If you submit reviews, images, or other content to the Site, you grant us a worldwide, royalty-free, non-exclusive, and sublicensable licence to use, reproduce, and display that content in connection with our business. You are responsible for ensuring your content is lawful and does not infringe the rights of others. We reserve the right to review and remove any user content at our discretion.

10. Third-Party Links & Payment Gateways

The Site may contain links to third-party websites or use third-party payment gateways. We are not responsible for the content, security, or practices of any third-party service, and your use of them is at your own risk. Any information you submit through a third-party payment provider is subject to that provider's terms and privacy practices.

11. Disclaimers & Limitation of Liability

The Site is provided on an "as is" and "as available" basis without warranties of any kind, express or implied. We do not warrant that the Site will be uninterrupted or error-free.

To the fullest extent permitted by law, Rayah shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or your purchase of our products. Our total liability in connection with any purchase is limited to the civil remedies available under UAE law, namely repair, replacement, refund, or store credit, where applicable and approved under the conditions of the sale.

12. Indemnification

You agree to indemnify and hold harmless Rayah and its officers, employees, and agents from any claims, liabilities, damages, losses, or expenses arising out of your use of the Site or your breach of these Terms.

13. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the United Arab Emirates. Any dispute arising in connection with the Site or a purchase shall be subject to the exclusive jurisdiction of the courts of Dubai.

By purchasing any item from Rayah, you acknowledge that the transaction constitutes a civil commercial relationship governed by the applicable civil and commercial laws of the UAE. Any dispute relating to authenticity, delivery timing, availability, quality expectations, refunds, exchanges, or after-sales service is strictly civil in nature and shall be resolved as follows:

a. First, directly with Rayah customer service, providing photographs, documentation, and reasonable time for assessment;

b. If unresolved, through the Dubai Department of Economy and Tourism (DET) for consumer mediation;

c. Failing that, before the competent Civil Courts of Dubai.

Both parties agree to act in good faith. You agree not to initiate a criminal complaint regarding matters relating to the purchase, authenticity, quality, delivery, description, or condition of goods, save where expressly required under UAE criminal law.

14. Changes to These Terms

We may modify these Terms at any time by posting the updated version on the Site. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
